Limit on Liability Agreement & Service Intake Form

LIMIT ON LIABILITY AGREEMENT

This Limit on Liability Agreement (“Agreement”) is entered into by and between Armchair Commandos LLC (“Company”) and the undersigned customer (“Customer”) as of the date of signature below.

1. Purpose

This Agreement outlines the limitations of liability accepted by Armchair Commandos LLC in connection with any item(s) submitted by Customer for customization, engraving, handling, or related services.

2. Scope of Liability

In the event that an item is damaged, lost, or rendered unusable while in the possession of Armchair Commandos LLC, the Company agrees to:

• Reimburse the Customer for the reasonable cost to repair or replace the item, not to exceed its fair market value at the time of damage.
• The      Company’s liability shall be strictly limited to the physical value of the item and does not include:
• Sentimental or emotional value
• Historical significance
• Tax stamps, licensing fees, or regulatory costs
• Any consequential or incidental damages

3. Risk Acknowledgment for Custom Work

Customer acknowledges that:

• Custom engraving or handling may involve inherent risks to the item’s finish, structure, or mechanical function.
• Minor cosmetic changes or imperfections may occur and are not considered damage if they fall within professional tolerances.

4. Pre-Work Documentation

The Company may photograph or document the item before work begins to establish its condition. These records may be used to resolve any future disputes regarding damage or alteration.

5. Customer Representations

Customer affirms that:

• The item submitted is legally owned and free of encumbrances.
• Any required permits, tax stamps, or legal documentation are the sole responsibility of the Customer.
• The Customer understands and accepts the limitations of liability as stated in      this Agreement.

6. Exclusions for Third-Party Components

Armchair Commandos LLC is not liable for damage to third-party accessories, aftermarket parts, or modifications not originally part of the item.

7. Indemnification

Customer agrees to indemnify and hold harmless Armchair Commandos LLC from any claims, losses, or legal actions arising from:

• Misrepresentation of item ownership or legality
• Failure to disclose relevant information about the item
• Any third-party claims related to the item

8. Dispute Resolution

Any disputes arising from this Agreement shall be resolved through binding arbitration in Maricopa County, Arizona, under applicable state law.

9. Entire Agreement

This document constitutes the entire agreement between the parties and supersedes any prior understandings, whether oral or written. No modification shall be valid unless in writing and signed by both parties.
